Definitions

• "We", "us", "our", "Hydra Labs" means the operator of FiveStatus.
• "FiveStatus", "the service" means the FiveStatus website, dashboard, public status pages, Discord bot, API, and everything we provide through them.
• "You", "your" means the person using the service, and where you use it on behalf of a community, organisation or business, that entity too.
• "Account" means your FiveStatus login.
• "Organisation" means the workspace that owns your servers, status page and team members.
• "Monitored server" means a FiveM (or compatible Cfx.re) game server you connect to FiveStatus for monitoring.
• "Status page" means the public page we publish for your organisation.
• "Your content" means anything you submit or publish through FiveStatus, including incident titles and updates, changelog posts, page titles, taglines, logos, images and links.

Agreement to these terms

By creating an account, connecting a server, or otherwise using FiveStatus, you agree to these terms. If you do not agree, do not use the service.

If you are using FiveStatus on behalf of a community, organisation or business, you confirm you have authority to accept these terms on its behalf, and "you" includes that entity.

Our Privacy Policy and Cookies Policy form part of these terms.

Eligibility and age

You must be at least 13 years old to use FiveStatus. If the law where you live sets a higher minimum age for consenting to online services without a parent or guardian, you must meet that age instead.

Discord's own terms require account holders to be at least 13, and higher in some countries. Because Discord sign-in is our primary login method, you must also meet Discord's requirements to use it.

We do not knowingly allow accounts for people under these ages. If we learn that an account belongs to someone below them, we will close it and delete the associated personal data.

Accounts and Discord sign-in

You can create an account either by signing in with Discord or with an email address and password. When you sign in with Discord you authorise us to receive your Discord user ID, username, avatar, email address (where you have one and have verified it) and the list of servers you are a member of. What we do with that is set out in our Privacy Policy.

You are responsible for the security of your account, including keeping your password secret if you use one and securing the Discord account you sign in with. Tell us promptly if you believe someone else has gained access to your account.

Each organisation has exactly one owner. The owner can invite others and assign them roles that limit what they can do. You are responsible for who you invite and what they do with the access you give them — including when access is granted automatically by a Discord role you have mapped.

Anyone who accepts your invitation gains the permissions attached to their role immediately. If you map a Discord role to a FiveStatus role, everyone holding that Discord role in your guild receives that access automatically, and loses it when the role is removed.

What the service does

FiveStatus:

• polls the public HTTP endpoints your FiveM server already exposes, at approximately 60-second intervals per server;
• records whether the server responded, how quickly, and the number of connected players and configured maximum;
• publishes a public status page showing current status, player counts, uptime history, incidents and changelog posts;
• can open an incident automatically when a server stops responding, and resolve it when the server responds again;
• can post incidents and changelog entries to a Discord channel you nominate, and provide slash commands in your guild;
• provides a read-only public API, an embeddable status badge, and link preview images.

Nothing needs to be installed on your game server. We only make requests to endpoints that are already reachable from the public internet.

Servers you connect

By connecting a server to FiveStatus you confirm that:

1. you own or operate that server, or you have permission from whoever does to monitor it and publish its status publicly;
2. the address you provide is reachable from the public internet and is not on a private, internal or otherwise restricted network;
3. you accept that we will make automated requests to it at regular intervals for as long as it remains connected.

We refuse addresses that resolve to private, loopback, link-local or otherwise reserved ranges. This is a deliberate safeguard and not something we will disable on request.

We validate a server before saving it and will not store a server we have not seen respond. If your server later stops responding, we will record that as a change of status, which may include automatically opening a public incident on your status page and posting it to your Discord channel.

You can pause monitoring or remove a server at any time from your dashboard. Removing a server also removes its recorded history.

Acceptable use

You must not use FiveStatus to:

• monitor a server you do not own or operate and do not have permission to monitor;
• attempt to have us make requests to hosts, ports or networks for the purpose of scanning, probing, overwhelming or otherwise attacking them;
• publish content that is unlawful, defamatory, harassing, hateful, sexually explicit, or that promotes violence or discrimination;
• publish content that infringes anyone's intellectual property, privacy or other rights;
• impersonate any person, community or organisation, or misrepresent your affiliation with one;
• publish personal data about players or other individuals — including names, identifiers, IP addresses or ban records — on your status page or changelog;
• use the service to distribute malware, phishing links, or content designed to deceive;
• circumvent plan limits, rate limits or access controls, or use the service in a way that places an unreasonable load on our infrastructure;
• scrape, resell or redistribute the service or data obtained from it, other than through the public API within its documented limits;
• reverse engineer, decompile or attempt to derive the source code of any part of the service, except to the extent that restriction is prohibited by law;
• breach any applicable law, or the terms of Discord, Cfx.re or any other platform you interact with through the service.

We may set and enforce reasonable technical limits — including request rate limits, polling frequency, and limits on servers, team members and stored history — and may change them where necessary to keep the service running for everyone.

Your content

You keep ownership of your content. You are responsible for it, including whether you have the right to publish it.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, adapt in format, and publish your content, for the sole purpose of operating and providing the service to you. This includes displaying it on your public status page, including it in link preview images and API responses, and posting it to the Discord channels you nominate. That licence ends when you delete the content or close your account, except for copies retained in routine backups for a limited period.

We do not routinely review your content before it is published. We may remove content that breaches these terms, and we may do so without notice where the content is unlawful or poses a risk to others.

Some information on your status page comes from your game server rather than from you — the server hostname, game type, map, banner image and other configuration values it publishes. You are responsible for that content in the same way as content you write.

Availability and accuracy

FiveStatus is a monitoring tool, not a guarantee. We do our best to report your server's status accurately and promptly, but you should not rely on it as the sole source of truth for anything critical.

In particular:

• we check from a single network location, so we may report a server as unreachable when it is reachable from elsewhere, or vice versa;
• we deliberately wait for several consecutive failed checks before reporting an outage, so there is a delay of a few minutes between a server going down and the page saying so;
• data comes from endpoints your server publishes, and we cannot verify that what it reports is correct;
• we depend on third parties — including the Cfx.re master list, Discord and our hosting providers — whose outages may delay or prevent updates and notifications;
• uptime figures are derived from our own checks and are not a service level measurement of your server, your host, or of FiveStatus itself.

We do not offer a service level agreement, uptime commitment, or service credits for FiveStatus itself. We may carry out maintenance, including maintenance that makes the service temporarily unavailable, and will try to give notice where it is planned.

To the fullest extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of satisfactory quality, fitness for a particular purpose, or non-infringement.

Plans, pricing and payment

FiveStatus offers a free plan and a paid plan called Pro. What each includes is described in our pricing section and may change over time.

The free plan is provided without charge and without commitment. We may change its limits, and if we reduce them materially we will give existing free accounts reasonable notice.

Pro

Pro costs £4.99 per month or £49.90 per year for one status page, in each case excluding any VAT or sales tax that applies to you. Tax is calculated at checkout based on the billing address you give us and is shown before you pay.

A subscription is bought for a status page rather than for a person. Any member of that page may purchase it. The page owner and its admins, together with the person whose payment method is on file, may change or cancel it. If that person leaves the page, the subscription remains with the page.

Pro renews automatically at the end of each billing period until it is cancelled. You can cancel at any time from the plan screen in your dashboard, and you may change your mind and restart it there at any point before it ends. Cancelling stops the next renewal; your subscription continues until the end of the period you have already paid for, and we do not pro-rate part-periods.

When a subscription ends, the page reverts to the free plan. Content and settings are not deleted: custom colours, hero images and custom domains remain stored and simply stop being served, and are restored if you subscribe again. Uptime history on the public page is shortened to the free window, and team members over the free limit are not removed, though no new members can be added until the page is back under the limit.

If a payment fails we will keep Pro active while our payment processor retries the charge. If it remains unpaid after those retries, the subscription ends and the page reverts to the free plan.

When you cancel we may offer you a discount to stay. Any such offer is optional, is described in full before you accept it, and accepting it does not change anything else about your subscription or your right to cancel later. Declining it cancels your subscription as normal.

We may also grant Pro to a status page at no charge, for a fixed period or indefinitely. A complimentary grant is a gift rather than a contract: it creates no payment obligation on either side, we may end it at any time, and when it ends the page reverts to the free plan on the same terms as any other.

Your right to cancel

Outside that right, payments are non-refundable, though if something has gone wrong we would always rather you told us: contact support@fivestatus.com.

Payments are processed by Stripe. We do not receive or store your card details. You are responsible for keeping your billing details accurate and for any taxes that apply to you.

We may change the price of Pro. Where we do, we will give you at least 30 days' notice by email before the change takes effect on your subscription, and you may cancel before it does.

Third-party services

FiveStatus depends on services operated by others. Using FiveStatus means your data will pass through them, and their terms apply to your use of them:

We are not responsible for third-party services, their availability, or their content. Links from FiveStatus to other sites — including other Hydra Labs products — are provided for convenience and are not an endorsement.

FiveStatus is an independent product. It is not affiliated with, endorsed by or sponsored by Cfx.re, FiveM, Rockstar Games, Take-Two Interactive or Discord.

Limitation of liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. If you are a consumer, nothing in these terms affects your statutory rights.

Subject to that, and to the fullest extent permitted by law:

1. we are not liable for loss of profits, loss of revenue, loss of business, loss of goodwill, loss of anticipated savings, loss of players or members, loss of data, or any indirect or consequential loss, however arising;
2. we are not liable for any loss arising from your reliance on the status, uptime or player figures we report, or from any failure or delay in reporting them, or from any notification we fail to deliver;
3. our total liability to you for all claims arising out of or in connection with the service in any twelve-month period is limited to the greater of the amount you paid us for the service in that period, or £50.

Because the free plan is provided without charge, our liability in respect of it is limited to £50 in aggregate.

Indemnity

If you are using FiveStatus other than as a consumer, you agree to indemnify us against any claim, loss, damage, cost or expense (including reasonable legal fees) arising from your content, from your use of the service in breach of these terms, or from a claim that a server you connected was monitored or published without the necessary permission.

Intellectual property

FiveStatus, its name, logo, design, code and documentation are owned by Hydra Labs and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable right to use the service in accordance with these terms. Nothing else is granted.

You may embed our status badge and link to your status page freely, including on commercial sites. You may not use our name or logo in a way that suggests we endorse you, or that we are affiliated with your community, without our permission.

If you believe content on FiveStatus infringes your rights, contact us at the address in section 19 with enough detail to identify the content and your claim, and we will review it promptly.

Suspension and termination

You can stop using FiveStatus at any time. You can delete servers, unpublish your status page, or close your organisation from the dashboard. Closing your organisation deletes its status page, its history and its content.

We may suspend or terminate your access, in whole or in part, if:

• you breach these terms, and the breach is serious or you do not put it right within a reasonable period of us asking;
• we are required to do so by law, or by a third-party service we depend on;
• your use is causing, or is likely to cause, harm to the service or to other users;
• we reasonably suspect fraudulent, abusive or unlawful activity.

Where practical we will tell you before we suspend or terminate, and explain why. Where the situation is urgent we may act first and tell you afterwards.

We may also discontinue the service entirely. If we do, we will give at least 30 days' notice to the contact address on your account and provide a way to export your incident and changelog content before it is removed.

Sections that by their nature should survive termination — including sections 8, 12, 13, 14 and 18 — continue to apply afterwards.

Changes to the service and these terms

We improve FiveStatus continuously, and features may be added, changed or removed. We will not make a change that materially reduces the core functionality of a paid plan during a period you have paid for without offering you a pro-rata refund.

We may update these terms. If a change materially affects your rights or obligations we will give at least 14 days' notice by email or through the dashboard before it takes effect, and the version number and date at the top of this page will change. Continuing to use FiveStatus after a change takes effect means you accept the updated terms. If you do not accept them, stop using the service and close your account.

Complaints and disputes

If something has gone wrong, tell us first. Most problems are resolved quickly and informally. Contact details are in section 19.

These terms and any dispute arising out of them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the UK or in the EU, you keep the benefit of any mandatory protections of the law of the country where you live, and you may bring proceedings in your local courts.

General

These terms, together with the Privacy Policy and Cookies Policy, are the whole agreement between us about FiveStatus, and replace anything said or written before.

If any part of these terms is found to be unenforceable, the rest continues to apply. If we do not enforce a right straight away, that does not mean we have given it up.

You may not transfer your rights or obligations under these terms without our written consent. We may transfer ours to a successor in connection with a merger, acquisition or sale of assets, and will tell you if we do.

No one other than you and us has any right to enforce these terms.

We are not liable for failures caused by events outside our reasonable control, including outages at our hosting or third-party providers, network failures, or acts of government.
